Nullification: States may use "nuclear option" to resist Federal health care mandates

It’s a strategy that proponents say gives individual states a means to correct or void unconstitutional legislation imposed by the Federal government.

Critics, meanwhile, say it is nothing more than a thinly-veiled effort to trump Federal authority by a process that was used during the days of segregation.

Now, the freshly-inked health care reform bill may soon be challenged by nullification, a way for states to invalidate or void certain requirements of the legislation…
